“Win an Apple iPad®” CONTEST (the “Contest”)
Official Contest Rules (the “Rules”)

The Contest is sponsored by Air Quality's One Hour (the “Sponsor”).

NO PURCHASE NECESSARY.


Void where prohibited by law.

Please read these rules in their entirety before entering the Contest.  Please do not enter the Contest unless you agree to these rules.  Participation in the Contest constitutes full and unconditional agreement and acceptance of these rules which are final on all matters relating to the Contest. 

1. HOW TO ENTER:
All customers who schedule and complete a sales and home analysis appointment (each an “Appointment”) with Air Quality's One Hourbetween April 15th, 2011 9am and June 30th, 2011 midnight (the “Contest Period”). The Appointment must be completed before July 1st, 2011 in order to be considered a valid Contest entry. Any Appointment that is cancelled or not completed will be disqualified from the Contest.

2. ELIGIBILITY:
The Contest is only open to an individual who:

  • is a legal resident of, and currently resides in the province of Ontario or Manitoba;
  • is 18 years of age or older at the time of Contest entry;
  • resides within the defined service area of the Sponsor branch;
  • is the legal owner and occupant of the single family home for which the Appointment is booked (the “Home”); and
  • is not an employee of the Sponsor, or of any of its affiliates, parent companies, subsidiaries, advertising and promotion agencies, or other coordinating agencies involved in the development, implementation and distribution of the Contest, or an immediate family member or person living in the same household of such an employee.

Limit of one (1) Contest entry per eligible household during the Contest Period.

No entry fee, payment, or proof of purchase is necessary to enter the Contest.  This Contest is subject to all federal, provincial and local laws and regulations.

3. PRIZE:
One (1) grand prize consisting of an Apple iPad®2 with Wi-Fi 16 GB will be awarded (the “Grand Prize”). Approximate retail value of the Grand Prize is $519 CAD.

4. PRIZE SUBSTITUTION:
Grand Prize is non-exchangeable, non-transferable, non-refundable, and must be accepted as awarded with no substitutions. The Sponsor reserves the right, in its sole discretion, to substitute and/or modify the Grand Prize with (a) prize(s) of equal or greater value for any reason.

5. PRIZE RESTRICTIONS:
The winner should allow four to six weeks for the distribution of the Grand Prize. In addition, the winner is responsible for any federal, provincial, and local tax consequences and for compliance with all governmental tax reporting and payment requirements. 

Prize may not be exactly as shown in Contest publicity or promotional materials. 

6. GRAND PRIZE WINNER SELECTION:
One (1) eligible winner will be selected by One Hour Heating & Air Conditioning in Hamilton, Ontario from among all eligible Appointment entries on July 15th, 2011 at 10 am. The eligible winner will be contacted by telephone within 72 hours of being selected.  If the selected entrant cannot be contacted within two weeks of the initial attempt, or if contacted does not claim the Grand Prize, or does not meet all of the Contest conditions outlined in these Rules, another entry will be selected from among all remaining eligible Appointment entries. 

The chances of winning the Grand Prize are solely dependent on the total number of eligible Appointment entries received during the Contest Period.

In order to be eligible to receive the Grand Prize, the selected entrant must correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by over the phone at a pre-arranged mutually convenient time.

7. GENERAL RULES & CONDITIONS
By participating in this Contest, entrants agree to be bound by these Rules.  Winner may be required to sign and complete a Declaration and Release and return the signed documents to the Sponsor before receiving the specified prize, otherwise the specified prize may be forfeited and awarded to an alternate entrant.  Winner consents to the use of his/her name, city of residence, likeness, and/or photograph without payment or compensation, in any publicity or advertising in any medium carried out by the Sponsor.  All entries become the property of the Sponsor and will not be returned.

These Rules and all matters related to the Contest will be governed by the laws of the Province of Ontario, without regard to its conflict of laws principles.

8. LIMITATION OF LIABILITY:
By entering this Contest or accepting any prize, each entrant agrees that the Sponsor, and its parent, subsidiaries, affiliates, directors, officers, shareholders, employees, advertising and promotion agencies involved in this Contest (the “Released Parties”) shall have no liability and shall be held harmless by the entrant for any damage, injury, death, loss, or liability to person or property, due in whole or in part, directly or indirectly, by reason of entering the Contest, the acceptance, possession, use or misuse of any prize, or while preparing for, participating in any prize-related activity.  Any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event, shall include legal fees.  The Released Parties are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the Contest.

9. TAMPERING:
If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the reasonable control of the Sponsor that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Contest and/or Rules.  In such event, the Sponsor may award the prize from among all eligible entries received up to the date of cancellation or suspension.  Sponsor further reserves the right to disqualify, from this Contest and future contests of the Sponsor, any individual who tampers with or in any way corrupts the entry process.  The Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in the Sponsor's sole discretion, the Sponsor determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or the Sponsor representatives.

CAUTION:  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING LAWYERS' FEES) FROM ANY SUCH ENTRANT OR ANY OTHER INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

10. CONSTRUCTION
This Contest and its Rules shall be governed by and construed under the laws of the Province of Ontario, without regard to conflicts of laws principles, and all entrants expressly agree that the Ontario courts shall have sole jurisdiction over any dispute or litigation arising from or relating to this Contest and agree to submit to the laws of and the jurisdiction of the federal courts of Canada and provincial courts of the Province of Ontario, and hereby waive the jurisdiction of any other court that now or in the future could be considered competent for any reason. The venue shall only be Toronto, Ontario.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

11. INFORMATION REGARDING THE ENTRANT
Certain information about entrants is required by the Sponsor to complete the Appointments, administer the Contest, and to verify and contact the winner. By completing an Appointment, entrants expressly consent to the Sponsor's collection use and disclosure of this information as provided herein, or as otherwise authorized or required by law.
